Hi, and welcome to the membership terms of The HoLT!
The HoLT is a membership platform provided by The House of LT Limited (we’ll refer to ourselves as ‘we’, ‘us’, and ‘our’). These Membership Terms apply to all members of The HoLT and where we refer to ‘you’ and ‘your’, we’re talking about the individual member of The HoLT.
Please excuse the formalities of these Membership Terms, but they are legally binding and important after all!
We’re an inclusive bunch at The HoLT, so if you need these Membership Terms in another format (such as audio, large print, or braille), please just let us know by emailing us at theholt@leaturner.co.uk.
1. Definitions
1.1. In these Membership Terms, we use certain words when we mean certain things. These are:
(a) “Features” means the services, events, advice, benefits, recommendations and any other features of any kind provided by us and our associated third parties under The HoLT as part of your Membership, as detailed in the Welcome Pack or as otherwise communicated to you by us;
(b) “Membership” means your membership to The HoLT;
(c) “Membership Fee” means the payment of £50 a month or £500 a year to be made by you to us for Membership;
(d) “Membership Terms” means the terms and conditions set out in this document, and any other rules of Membership contained in the Welcome Pack or as otherwise communicated to you by us; and
(e) the “Welcome Pack” means the document provided by us to you at the start of your Membership, as may be updated from time to time and reissued to you.
2. Agreement to these Membership Terms
2.1. By obtaining and continuing to hold Membership, you agree that you have read these Membership Terms and agree to be bound by them.
2.2. You acknowledge that any breach of these Membership Terms may entitle us to suspend or cancel your Membership.
3. Features under The HoLT
3.1. The Features we provide under The HoLT may include:
(a) live and pre-recorded online third-party expert masterclass events;
(b) advice clinics to advise on your use of, and presence on, LinkedIn;
(c) monthly content advice delivered by email;
(d) access to The HoLT community via Slack;
(e) third-party discounts;
(f) recommendations of trusted third-party services providers; and
(g) early access to organised events.
3.2. The Features are provided under and subject to these Membership Terms.
3.3. We will reasonably endeavour to provide the Features, but no guarantees can be provided in respect of third parties we use to provide, and to help to provide, the Features.
3.4. We may make changes to all or any aspects of the Features at any time providing the nature or quality of the Features aren’t materially affected. We will try to let you know in advance of making any changes.
4. Your Obligations
4.1. You will not distribute or share any aspects of the Features with any third party who is not a member of The HoLT.
4.2. You will not share your login details to the library of information provided under The HoLT with any third party.
4.3. You will at all times conduct yourself and your Membership with respect and in accordance with the rules detailed in the Welcome Pack.
5. Membership Period
5.1. If you pay the Membership Fee annually (and subject to payment of the same), your Membership is for an initial term of 12 months, unless Membership is cancelled under these Membership Terms.
5.2. After the first 12 months, providing you choose to continue paying the Membership Fee annually (and subject to payment of the same), your Membership will renew for a further 12 months and then for further 12-month periods after that.
5.3. If you pay the Membership Fee monthly (and subject to payment of the same), your Membership is for a rolling monthly period, unless Membership is cancelled under these Membership Terms.
6. Membership Fee
6.1. You will pay the Membership Fee by direct debit.
6.2. Where the Membership Fee is paid monthly, this will be paid in advance and must be received by us prior to the start of the new month.
6.3. Any missed payments of the Membership Fee will entitle us to suspend or cancel your Membership.
7. Warranties and Liability
7.1. We warrant that any Features we provide under The HoLT will be carried out using reasonable care and skill.
7.2. We cannot give any warranty or guarantee in respect of any Features provided by third parties.
7.3. Except in cases of death or personal injury caused by our negligence, we will not be liable for any losses you suffer or incur in connection with or arising out of your Membership or any of the Features, and in no circumstances will our liability exceed 100% of the Membership Fee you have paid to us in the 12-month period preceding the action giving rise to a claim against us.
7.4. We will not be liable for any losses you suffer or incur by reason of any delay or failure to provide any of the Features caused by any event outside our control. In respect of any cancelled Features where an additional fee was payable, our liability will be limited to refunding the fee where you are unable to attend such Feature at the rescheduled date (if any).
8. Cancelling your Membership
8.1. You can cancel your Membership at any time by giving us notice to theholt@leaturner.co.uk.
8.2. We may suspend or cancel your Membership at any time if you are in breach of any of these Membership Terms, or if we receive a complaint about your conduct from other members of The HoLT.
8.3. Refunds of the Membership Fee will be at our sole discretion. However, no full or partial refund of the Membership Fee will be made under any circumstances if you have redeemed or exercised the Feature named “Free 30 Minute 1:1 with Lea” (or such Feature as may be renamed from time to time).
8.4. Your right to access the Features will immediately end upon cancellation of your Membership. Your obligations under section 4 will remain in full force and effect after cancellation of your Membership.
9. Intellectual Property
9.1. All intellectual property which exists in the Features are owned by us or our third-party content providers.
9.2. Your Membership does not give you any right to use our, or our third parties’, intellectual property in any way other than in the normal course of your Membership.
10. Confidentiality
Neither you nor we will use any confidential information of the other for any purpose other than to perform its obligations under these Membership Terms.
11. Data Protection
11.1. You will need to provide us with certain personal data for you to obtain and continue to hold Membership.
11.2. We will use your personal data in accordance with our Privacy Policy, which can be found here.
12. General
12.1. Assignment: You may not assign, sub-contract or transfer your Membership or any right or obligation under these Membership Terms without our prior written consent.
12.2. Severance: If any provision of these Membership Terms is or becomes unenforceable, the rest of the Membership Terms will not be affected.
12.3. Waiver: No delay or failure by us to exercise any right or remedy under these Membership Terms or by law will operate as a waiver of that right or remedy, nor will we be prevented or restricted from exercising that right or remedy in future.
12.4. Governing Law and Jurisdiction: Your Membership, these Membership Terms and any dispute arising out of or in connection with them will be governed by and construed in accordance with the laws of England and Wales. The parties irrevocably agree that the courts of England and Wales will have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with your Membership or these Membership Terms.
